These Terms and Conditions ("Terms") govern your use of the website located at insulationcompanyduluth.com and your relationship with Duluth Insulation ("we," "us," or "our"), a home insulation contractor located in Duluth, MN. By using this website or engaging our services, you agree to these Terms.
By accessing this website, submitting a contact or estimate request, or hiring Duluth Insulation to perform work at your property, you confirm that you have read and agree to these Terms. If you do not agree, please do not use this website or engage our services.
We reserve the right to update these Terms at any time. Changes take effect when posted to this page with a new effective date. Your continued use of the website or services after changes are posted constitutes acceptance of the updated Terms.
Duluth Insulation provides residential and commercial insulation services in Duluth, MN and surrounding communities. Services include but are not limited to spray foam insulation, attic insulation, blown-in insulation, crawl space insulation, basement insulation, air sealing, vapor barrier installation, insulation removal, and related work.
This website is for informational purposes only. Nothing on this website constitutes a binding offer, contract, or guarantee of service availability, pricing, or scheduling. All service engagements are governed by a written agreement or accepted estimate provided directly to the customer.
All estimates provided by Duluth Insulation are free and non-binding until accepted in writing by both parties. Estimates are based on information available at the time of the site visit and are valid for 30 days unless otherwise noted. Prices are subject to change if site conditions differ materially from what was observed during the initial assessment, or if the scope of work changes.
Any price quoted verbally is not binding. Written estimates are the only authoritative record of agreed pricing. Additional work discovered during the project that was not included in the original estimate will be communicated to the customer before that work is performed and before any additional cost is incurred.
Once a project date is confirmed, we ask for at least 48 hours' notice if you need to reschedule. Cancellations or reschedules with less than 48 hours' notice may result in a rebooking fee, which will be communicated to you at the time of scheduling.
We reserve the right to reschedule or cancel appointments due to weather conditions, equipment issues, or other circumstances outside our control. In such cases, we will notify you as soon as possible and work with you to find the earliest available replacement date.
Some insulation materials, including spray foam, cannot be applied below certain temperatures. If temperature or weather conditions on the scheduled day are outside acceptable installation parameters, we may need to reschedule at no charge to you.
Payment is due upon completion of the work unless other arrangements have been agreed in writing in advance. We accept cash, check, and major credit cards. A deposit may be required for larger projects, in which case this will be stated in the written estimate before work begins.
Invoices not paid within 30 days of the completion date may be subject to a late fee of 1.5% per month on the outstanding balance. If collection becomes necessary, the customer agrees to pay reasonable collection costs and attorney fees incurred by Duluth Insulation.
Duluth Insulation warrants that all work will be performed in a workmanlike manner consistent with industry standards. If a defect in our workmanship is identified within one year of project completion and is reported to us in writing, we will return to assess and remedy the issue at no additional charge, subject to the limitations described below.
This workmanship warranty does not cover damage caused by water intrusion, structural movement, pest activity, acts of nature, improper use, modifications made by others after the project completion, or any pre-existing conditions that were identified before or during the project.
Manufacturer warranties on materials are separate from our workmanship warranty and are subject to the terms of each manufacturer. We make no representations about the performance of materials beyond what manufacturers document themselves.
This website and its content are provided "as is" without warranties of any kind, express or implied, including accuracy, completeness, or fitness for a particular purpose.
To the fullest extent permitted by law, Duluth Insulation'stotal liability for any claim arising out of or related to our services or this website is limited to the amount paid by the customer for the specific project giving rise to the claim.
We are not liable for indirect, incidental, special, or consequential damages, including loss of use, loss of revenue, or property damage that is not directly caused by our workmanship. Some states do not allow the exclusion of certain damages, so these limitations may not apply to you in full.
You agree to provide accurate information when requesting an estimate or scheduling services, including the correct address, access instructions, and any known conditions that could affect the work (such as prior water damage, pest activity, or existing materials containing asbestos or other hazardous substances).
For spray foam insulation projects, customers must vacate the premises - including all people and pets - during installation and for a minimum of 24 hours afterward. Failure to do so releases Duluth Insulation from any liability related to occupant exposure during or after application.
You are responsible for ensuring our crew has safe, unobstructed access to the work area on the scheduled project date. If access is blocked and we cannot complete the work, a trip charge may apply.
If a dispute arises between you and Duluth Insulation related to our services or these Terms, we ask that you first contact us directly to attempt to resolve the issue informally. Most concerns can be addressed quickly with a direct conversation.
If a dispute cannot be resolved informally, both parties agree to attempt mediation before pursuing litigation. If mediation fails, disputes will be resolved through binding arbitration in Duluth, MN, under the rules of the American Arbitration Association, unless applicable law requires otherwise.
These Terms are governed by the laws of the State of Minnesota, without regard to its conflict of law principles. Any legal action not subject to arbitration will be brought in the state or federal courts located in Duluth, Minnesota.
